Resolution No. 180 of 1980

Date of entry into force: 1980

In accordance with the provisions of para (a) of Article 42 of the Interim Constitution،

The Revolutionary Command Council have decided on their session held on 03.02.1980 the following:

1. The Minister of Interior may accept the naturalization of major foreigner on following conditions:

a)To be residing in Iraq before the Revolution of July 14، 1958 and continuing the residence with the date of enforcement of this Resolution:

b)That one of his relatives of first or second degree has obtained the Iraqi Nationality.

c)That his existence in Iraq is not harmful to security and safety of the Republic of Iraq.

d)That he submits the application for naturalization within the period of the enforcement of this resolution.

2. The Minister of Interior may accept the naturalization of the foreigner major، of members of tribes (Al-Sora Miry، Kar Kash، Al-Zarkush، Malakshahi، Kara Los، Failiyah and Al-Arkwazia) on the following conditions:

a)To be residing in Iraq for a period not less than consecutive (fifteen years) prior to the enforcement of this resolution.

b)That his existence in Iraq is not harmful to security and safety of the Republic of Iraq.

c)That he submits the application for naturalization within the period of execution of this resolution.

3. The Minister of Interior may accept naturalization ofmajor foreigner of members of (Al-Guyan) tribe in the same conditions provided for in para (2) of this resolution.

4. The Minister of Interior may accept naturalization of foreigner married to an Iraqi woman on the following conditions:

a)That his existence in Iraq is not harmful to the security and safety of the Republic of Iraq.

b)That he submits the application for naturalization within the period of execution of this resolution.

c)Continuity of marriage until submission of application.

d)That he is residing in Iraq before the year 1958 and his residence is continuous.

5. a)The Minister of Interior may accept acquirement of foreign woman of nationality of her Iraqi husband on condition of elapse of (three years) in marriage and her residence along the said period and continuity of marriage until the submission of application.

b)A foreign woman، married to an Iraqi whose residence in Iraq of five years have been elapsed، may not be allowed to continue her residence therein. She must within six months from the date of execution of this resolution declare her wish to acquire the nationality of her Iraqi husband or she must depart Iraq.

c)A foreign woman married to an Iraqi must choose between acquirement of Iraqi nationality or her departure from Iraq after passing the period of (three years) provided for، in Item (A) of this para. She will be obliged to depart Iraq if five years have elapsed on her residence without choosing the Iraqi nationality.

6. Each foreigner granted the Iraqi nationality under the provisions of this resolution must take the oath of loyalty to the Republic of Iraq before the competent Director of Nationality within one month from calling him. The person shall be regarded as Iraqi from the date of taking this oath.

7. The foreigner residing in Iraq in a period not less than ten consecutive years prior to the enforcement of this resolution and one of his ascendants or descendants has acquired the Iraqi nationality must، within the period of enforcement of this resolution، declare his wish in the naturalizing with the Iraqi nationality or to depart Iraq.

8. This resolution shall apply to persons existing in Iraq at the time of its enforcement with observance of what is set out in item (c) of para (5) thereof. Its provision shall apply to foreign woman existing in Iraq at the time of its enforcement and to conditions that come out after this date.

9. The Minister of Interior may issue Instructions for facilitation of execution of this resolution.

10. This resolution shall be published in the official Gazette and shall be enforced for a period of six months except the provision set out in item (c) of para (5) thereof.
